Migración Riviera Maya (hereinafter, “the Controller”), with its known address in Playa del Carmen, Solidaridad, Quintana Roo, C.P. 77710, in compliance with the Mexican Federal Law on the Protection of Personal Data Held by Private Parties and its Regulations (together, hereinafter, “the Law”), hereby informs you that it collects and processes your Personal Data (as defined below) for the purposes set out in this Privacy Notice.
The Controller collects the following Personal Data:
(hereinafter, “the Personal Data”), for the purposes necessary to create your file and provide you with the service and personalised attention you requested.
In accordance with the Law, we require your express consent to process Personal Data of a financial or asset-related nature. If you do not state your objection to such processing, you will be deemed to have given the Controller your express consent for it. In any case, the Controller undertakes not to process this Personal Data for purposes other than those set out in this Privacy Notice, except for the exceptions provided for in the Law.
We inform you that your Personal Data may be transferred by the Controller, both within and outside Mexico, to Mexican Embassies and Consulates abroad, to the Ministry of Foreign Affairs and to the National Immigration Institute, in order to comply with applicable regulations.
If you wish your Personal Data to be transferred to third parties for these purposes, you must inform the Controller using the following contact details: info@migracionrivieramaya.com. If you do not state your refusal of such transfers, you will be deemed to have given the Controller your consent to carry them out.
You have the right to access the Personal Data we hold and the details of its processing, to rectify it if it is inaccurate or incomplete, or to cancel it when you consider that it is not required for any of the purposes set out in this Privacy Notice.
We ask that your request include a clear and precise description of the data in respect of which you wish to exercise any of these rights, as well as any other element that allows us to identify or locate the Personal Data in question. In the case of rectification, you must also indicate the exact change you wish to make and provide documentation supporting the request.
Additionally, for your protection and benefit, we may request further documentation allowing us to fully identify the Personal Data you wish to access, rectify or cancel, or that which you wish to object to the processing of. We also inform you that the Controller may be unable to cancel or block your Personal Data, in accordance with the provisions of the Law.
Once your complete and duly submitted request has been received, the Controller will communicate its response within a maximum of 10 business days. If the request is granted, the requested right may be exercised within the following 15 business days. Where the Controller must deliver documentation as a result of the right exercised, it will do so by providing originals for verification purposes only, together with copies.
Please note that, for certain purposes, withdrawing your consent will mean we can no longer provide you with the service or attention requested, or that your relationship with the Controller comes to an end. It is also possible that, due to a legal obligation, the Controller may be required to continue processing your Personal Data.
Should you wish to withdraw your consent to the processing of your Personal Data, you must submit your request to the Controller together with a copy of your official identification, in order to prove that you are the data subject (or, where applicable, the authorisation of your legal representative), and indicate the email address or postal address at which you wish to receive information relating to the procedure, along with a clear and precise description of the data enabling us to notify you of the outcome. The Controller will notify you of the corresponding resolution within the 10 business days following the submission of your request, provided it is complete and duly submitted.
So that you may limit the use and disclosure of your personal information, you may register with the Public Registry to Avoid Advertising (Registro Público para Evitar Publicidad), maintained by the Federal Consumer Protection Agency (PROFECO), so that your Personal Data is not used to send you advertising or promotions.
The Controller may make amendments or updates to this Privacy Notice at any time, arising from new legal requirements, from its privacy policies or practices, from needs relating to the products or services it offers, or for any other reason.
The Controller reserves the right to update this Notice periodically, communicating this through its website. By continuing to use the site or providing your Personal Data, you acknowledge that you have read, understood and accepted the terms set out herein, which constitutes your consent to the processing of your Personal Data and to any changes or updates to this Notice.
By providing your Personal Data to the Controller, you expressly consent to it being processed as set out in this Notice and protected under the terms established by the Law, with the Controller adopting measures to guarantee the security of such Personal Data and prevent its alteration, loss or unauthorised transmission.
